Do Partisan Elections of Judges Produce Unequal Justice? When Courts Review Employment Arbitrations

Michael LeRoy
October 29, 2010

Michael LeRoy, professor in the School of Labor and Employment Relations and the College of Law, presented preliminary empirical research arguing that employees fare measurably worse when partisan-elected state trial judges review employment arbitration awards. He walked through the Massey Energy/Caperton case, Citizens United, and Gilmer, then took extended audience questions on recusal rules, disclosure laws, and campaign finance. Fall 2010 series "Deconstructing the American Dream."
